An old wetland fill violation on land in Ocean Shores, prompted Timberland Bank’s attorney to contact SCJ’s environmental specialists. We contacted EPA and the Army Corps of Engineers (USACE) to define details for a potential resolution.

We were able to negotiate the details of a wetland creation/mitigation project that can release the violation restriction on the parcel, making it possible for the bank to take ownership without being held responsible for the past owner’s indiscretions.

STAFF STORY

“This project required good communication skills as well as an excellent grasp of federal rules and mitigation options. I was excited about helping find a resolution for this violation, which had been in limbo with two federal agencies, the local municipal government, and the mortgage owner since 2006. We are currently waiting for final negotiations between the bank’s attorney and EPA attorney, finding agreement language that will ensure the bank can sell the property once the wetland creation is completed.”
